I. PRIVACY POLICY AND DATA PROTECTION

In compliance with current legislation, Pinfruse (hereinafter, also the Website) undertakes to adopt the necessary technical and organizational measures, according to the appropriate level of security for the risk of the collected data.

This privacy policy is adapted to the current Spanish and European regulations on the protection of personal data on the Internet. Specifically, it complies with the following regulations:

Personal Data Record

In compliance with the provisions of the GDPR and the LOPD-GDD, we inform you that the personal data collected by Pinfruse through the forms extended on its pages will be incorporated and processed in our file in order to facilitate, expedite and fulfill the commitments established between Pinfruse and the User or maintain the relationship established in the forms that the latter fills in, or to respond to a request or inquiry. Likewise, in accordance with the provisions of the GDPR and the LOPD-GDD, unless the exception provided for in Article 30.5 of the GDPR applies, a record of processing activities is maintained that specifies, according to its purposes, the processing activities carried out and other circumstances established in the GDPR.

Principles applicable to the processing of personal data

The processing of the User’s personal data shall be subject to the following principles set out in Article 5 of the GDPR and in Article 4 et seq. of Organic Law 3/2018, of December 5, on the Protection of Personal Data and guarantee of digital rights:

  • Lawfulness, fairness and transparency: the User’s consent will be required at all times with full transparency on the purposes for which the personal data are collected.
  • Purpose limitation: personal data will be collected for specified, explicit and legitimate purposes.
  • Data minimization: personal data collected shall be only those strictly necessary in relation to the purposes for which they are processed.
  • Accuracy: personal data must be accurate and kept up to date.
  • Storage limitation: personal data will only be kept in a way that allows the identification of the User for as long as necessary for the purposes of the processing.
  • Integrity and confidentiality: personal data will be processed in a manner that ensures its security and confidentiality.
  • Accountability: the Data Controller shall be responsible for ensuring that the above principles are complied with.

Categories of personal data

The categories of data processed by Pinfruse are only identifying data. In no case are special categories of personal data processed within the meaning of Article 9 of the GDPR.

Legal basis for the processing of personal data

The legal basis for the processing of personal data is consent. Pinfruse undertakes to obtain the User’s express and verifiable consent to the processing of their personal data for one or more specific purposes.

The User shall have the right to withdraw their consent at any time. Withdrawing consent shall be as easy as giving it. As a general rule, the withdrawal of consent shall not condition the use of the Website.

When the User is required or may provide their data through forms to make inquiries, request information, or for reasons related to the content of the Website, they will be informed if the completion of any of them is mandatory due to being essential for the proper development of the operation performed.

Purposes of the processing for which the personal data are intended

The personal data are collected and managed by Pinfruse for the purpose of facilitating, expediting, and fulfilling the commitments established between the Website and the User or maintaining the relationship established in the forms completed by the latter or to respond to a request or inquiry.

Retention periods for personal data

Personal data of minors

In compliance with Articles 8 of the GDPR and 7 of Organic Law 3/2018, of December 5, only individuals over 14 years of age may lawfully give their consent for the processing of their personal data by Pinfruse. In the case of a minor under 14 years of age, the consent of the parents or guardians will be required for the processing, and it will only be considered lawful to the extent that they have authorized it.

Secrecy and security of personal data

Pinfruse undertakes to adopt the necessary technical and organizational measures, according to the appropriate level of security for the risk of the collected data, to ensure the security of personal data and prevent their accidental or unlawful destruction, loss or alteration, or unauthorized disclosure or access.

The Website is equipped with an SSL (Secure Socket Layer) certificate, which ensures that personal data is transmitted securely and confidentially, as the transmission of data between the server and the User, and in feedback, is fully encrypted or encoded.

However, since Pinfruse cannot guarantee the absolute impregnability of the Internet or the total absence of hackers or others who fraudulently access personal data, the Data Controller undertakes to notify the User without undue delay when a breach of personal data security occurs that is likely to result in a high risk to the rights and freedoms of natural persons. Personal data will be treated as confidential by the Data Controller, who undertakes to inform and guarantee by legal or contractual means that such confidentiality is respected by their employees, partners, and any person to whom the information is made accessible.

Rights arising from the processing of personal data

The User has rights with respect to Pinfruse and may therefore exercise the following rights recognized in the GDPR and Organic Law 3/2018:

  • Right of access: The right of the User to obtain confirmation of whether or not Pinfruse is processing their personal data and, if so, obtain information about their specific personal data and the processing that Pinfruse has carried out or carries out, as well as other information available about the origin of the data and the recipients of any communications made or planned for such data.
  • Right to rectification: The right of the User to have inaccurate personal data rectified or, considering the purposes of the processing, completed.
  • Right to erasure (“the right to be forgotten”): The right of the User, provided that current legislation does not provide otherwise, to obtain the erasure of their personal data when it is no longer necessary for the purposes for which it was collected or processed; the User has withdrawn consent and there is no other legal basis for processing; the User objects to the processing and there is no other legitimate reason to continue processing; the personal data has been processed unlawfully; the personal data must be erased in compliance with a legal obligation; or the personal data has been collected from a direct offer of services to a minor under 14 years. In addition to erasing the data, the Data Controller, considering the technology available and the cost of implementation, must take reasonable steps to inform controllers processing the personal data of the data subject’s request to erase any links to such data.
  • Right to restriction of processing: The User has the right to restrict the processing of their personal data under certain circumstances.
  • Right to data portability: If the processing is carried out by automated means, the User has the right to receive their personal data from the Data Controller in a structured, commonly used and machine-readable format, and to transmit it to another controller.
  • Right to object: The User’s right to object to the processing of their personal data or to have the processing of such data ceased by Pinfruse.
  • Right not to be subject to a decision based solely on automated processing, including profiling: The right of the User not to be subject to an individualized decision based solely on automated processing, including profiling, unless provided otherwise by applicable law.

In cases where representation is accepted, identification by the same means of the person representing the User will also be necessary, as well as the document accrediting the representation.   • Address for notification purposes.
  • Date and signature of the applicant.
  • Any document that accredits the request being made.

II. ACCEPTANCE AND CHANGES TO THIS PRIVACY POLICY

It is necessary that the User has read and agrees with the conditions regarding the protection of personal data contained in this Privacy Policy, as well as accepts the processing of their personal data so that the Data Controller can proceed with the same in the form, during the periods and for the purposes indicated. The use of the Website will imply acceptance of its Privacy Policy.

Pinfruse reserves the right to modify its Privacy Policy, according to its own criteria, or due to a legislative, jurisprudential or doctrinal change of the Spanish Data Protection Agency.
